Terms of Service

Welcome to Bloedstone. These Terms of Service ("Terms") govern your access to and use of the Bloedstone website located at https://bloedstone.com (the "Site") and any services offered through the Site (collectively, the "Services"). The Site and Services are operated by Bloedstone, a California for-profit entity ("Bloedstone," "we," "us," or "our").
By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site or Services.
1. Acceptance of Terms
By creating an account, making a purchase, or otherwise using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Bloedstone.
2. Changes to Terms
We reserve the right to modify or update these Terms at any time at our sole discretion. When we make changes, we will update the "Effective Date" at the top of these Terms. For registered users, we will notify you of material changes by email to the address associated with your account at least 30 days before the changes take effect. Your continued use of the Site or Services after such changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.
3. User Accounts
3.1 Account Creation
To access certain features of the Services, you may be required to create an account. When creating an account, you must provide accurate and complete information, including your name and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Account Security
You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information. We recommend enabling multi-factor authentication when available to enhance your account security.
3.3 Account Termination
You may terminate your account at any time by emailing us at hello@bloedstone.com. We will process your account termination request within 30 days. We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in fraudulent or illegal activity. Upon termination, your right to use the Site and Services will immediately cease.
4. Use of Services
4.1 License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for your personal, non-commercial use.
4.2 Prohibited Conduct
You agree not to:
- Use the Site or Services for any illegal purpose or in violation of any applicable laws
- Interfere with or disrupt the Site, Services, or servers or networks connected to the Site
- Attempt to gain unauthorized access to any portion of the Site, Services, or any systems or networks
- Use any automated means, including robots, crawlers, or scrapers, to access the Site without our express written permission
- Transmit any viruses, malware, or other malicious code
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Collect or harvest any information from the Site or other users
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site or Services
- Make unauthorized commercial use of products purchased through the Site, including reselling products without authorization
- Submit fraudulent payment information or engage in fraudulent chargebacks
5. E-Commerce and Transactions
5.1 Product Purchases
The Site allows you to purchase products through our e-commerce platform. All purchases are subject to product availability. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or suspected fraudulent activity.
5.2 Pricing and Payment
All prices are listed in U.S. dollars and are subject to change without notice. You agree to pay all charges incurred in connection with your purchases at the prices in effect when such charges are incurred. We use third-party payment processors, including PayPal, Shop Pay, and Shopify, to process payments. When you make a purchase, you will be directed to the website of the applicable payment processor, which operates under its own terms of service and privacy policy. By making a purchase, you agree to the terms and conditions of these payment processors. We do not store your complete payment card information on our servers.
5.3 Returns and Refunds
We want you to be satisfied with your purchase. Our returns and refunds policy is as follows:
- Return Window: All rings (regardless of metal) and any solid gold or platinum pieces are final sale. We accept returns within 7 days of delivery on unworn sterling silver necklaces and unused accessories. We cannot accept returns/exchanges on any items that have been personalized (engraving, custom length chain, etc).
- Condition: Items must be unused, unworn, unwashed, and in original condition with all tags attached.
- Return Process: To initiate a return, please contact us at hello@bloedstone.com with your order number and reason for return. We will provide you with return instructions.
- Refund Processing: Refunds will be issued to your original payment method within 7-10 business days after we receive and inspect the returned item.
- Return Shipping: You are responsible for return shipping costs unless the return is due to our error or a defective product.
- Non-Returnable Items: All rings (regardless of metal) and any solid gold or platinum pieces are final sale. We cannot accept returns/exchanges on any items that have been personalized (engraving, custom length chain, etc) or custom made.

6. Intellectual Property Rights
6.1 Ownership
The Site and Services, including all content, features, and functionality (including but not limited to text, graphics, logos, images, software, and design), are owned by Bloedstone and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You acknowledge that the Site and Services contain proprietary information and material that is protected by applicable intellectual property and other laws.
6.2 Restrictions
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content on the Site, except as follows:
- You may print or download one copy of a reasonable number of pages of the Site for your personal, non-commercial use
- You may share content through social media sharing features provided on the Site
Any other use requires our prior written consent.
7. Third-Party Links and Services
The Site may contain links to third-party websites or services that are not owned or controlled by Bloedstone, including links to our payment processors (PayPal, Shop Pay, and Shopify) and social media platforms. When you click on these links, you will be directed to third-party websites that operate under their own terms of service and privacy policies.
We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Bloedstone shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with your use of any third-party websites or services. We strongly advise you to read the terms of service and privacy policies of any third-party websites or services that you visit.
8. Disclaimers
THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BLOEDSTONE DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE OR ANY HYPERLINKED WEBSITE, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY MONITOR ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLOEDSTONE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY EVEN IF YOUR REMEDIES UNDER THESE TERMS FAIL OF THEIR ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless Bloedstone, its affiliates, and their respective directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any rights of another party, including any intellectual property rights; or (d) your violation of any applicable laws or regulations.
This indemnification obligation will survive the termination or expiration of these Terms and your use of the Site and Services.
11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
11.2 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration in Los Angeles County, California, in accordance with the Consumer Arbitration Rules of the American Arbitration Association then in effect. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Notwithstanding the foregoing, either party may seek equitable relief (including injunctive relief) in a court of competent jurisdiction to protect its intellectual property rights or confidential information.
11.3 Arbitration Opt-Out
You have the right to opt out of the arbitration provision set forth above. To opt out, you must notify us in writing within thirty (30) days of the date you first accept these Terms (or within thirty (30) days of any material change to this arbitration provision). Your written opt-out notice must be sent by email to hello@bloedstone.com with the subject line "Arbitration Opt-Out" and must include your name, address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, all other terms of these Terms will continue to apply, but disputes will be resolved in court rather than through arbitration.
11.4 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF ANY COURT OR ARBITRATOR DETERMINES THAT THE CLASS ACTION WAIVER SET FORTH IN THIS PARAGRAPH IS VOID OR UNENFORCEABLE FOR ANY REASON, OR THAT AN ARBITRATION CAN PROCEED ON A CLASS BASIS, THEN THE ARBITRATION PROVISIONS SET FORTH ABOVE SHALL BE DEEMED NULL AND VOID IN THEIR ENTIRETY, AND THE PARTIES SHALL BE DEEMED TO HAVE NOT AGREED TO ARBITRATE DISPUTES.

By using the Site and Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

14. Severability

The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that most closely reflects the original intent of the provision.
15. Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Bloedstone.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein (including our Returns and Refunds Policy), constitute the entire agreement between you and Bloedstone regarding the Site and Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.
17. Assignment
You may not assign or transfer these Terms or any of your rights or obligations hereunder without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may assign or transfer these Terms without restriction, including to any affiliate or successor entity. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
18. Survival
The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, limitations of liability, dispute resolution provisions, and governing law provisions.
19. Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, acts of God, war, terrorism, natural disasters, pandemics, labor disputes, or governmental actions.
